This website is operated by LYX Fragrance Lab Co. Throughout the site, the terms “we”, “us”, and “our” refer to LYX Fragrance Lab Co. SECTION 1 - FRAGRANCE USE & COSMETIC SAFETY
1.1 External Use Only: All fine fragrance products, liquid formulations, and cosmetics produced or sold by LYX Fragrance Lab Co. are intended exclusively for external application. Products must not be ingested, applied near eyes or mucous membranes, or used on broken, inflamed, or irritated skin.
1.2 Allergen Notice & Patch Testing: Our fine fragrances are formulated using perfumer's alcohol (SDA 40-B), fixatives, essential oils, and concentrated aroma compounds. Customers are strongly advised to perform a patch test on a small area of skin 24 hours prior to general use. LYX Fragrance Lab Co. assumes no liability for individual skin sensitivities, unexpected allergic reactions, or adverse physical effects resulting from application.
1.3 Flammability & Safety: Our spray formulations contain high-proof ethanol and are flammable. Keep all products away from direct heat, open flames, sparks, or hot surfaces. Store out of reach of children and pets.
SECTION 2 - INTELLECTUAL PROPERTY & TRADEMARK DISCLAIMER
2.1 Independent Enterprise: LYX Fragrance Lab Co. is an independent fine fragrance enterprise.
2.2 Comparative Olfactory References: Any references made on this website to trademarked brand names, luxury houses, or specific designer fragrances are strictly intended for olfactory description and comparative purposes. They serve solely to inform the customer of the scent profile, character, or key notes.
2.3 No Affiliation: LYX Fragrance Lab Co. has no direct or indirect affiliation, association, endorsement, sponsorship, or licensing agreement with any third-party brand or trademark holder referenced on this site.
SECTION 3 - ACCURACY OF PRODUCT DETAILS & FORMULATIONS
3.1 Hand-Compounded Products: Due to the artisanal compounding and bottling process of fine fragrances, slight natural color variations or batch-to-batch nuances in scent development may occur and do not constitute product defects.
3.2 Pricing & Product Changes: Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue products, collections (including the Catalyst Series), or services without liability.
SECTION 4 - SHIPPING, HAZMAT & RESTRICTED GOODS
4.1 Transport Regulations: Because fine fragrances contain high-proof ethanol, they are legally classified as Class 3 Flammable Liquids under transport safety laws. As a result, orders containing spray fragrances must be shipped strictly via compliant ground transportation services.
4.2 Regional Restrictions: Air shipping or international shipping may be restricted or subject to special carrier handling depending on local transit regulations and carrier policies regarding alcohol-based liquids.
SECTION 5 - RETURNS, HYGIENE & REFUNDS
5.1 Sanitation & Final Sale: Due to cosmetic hygiene, health regulations, and product integrity standards, unsealed, opened, or used fragrance bottles cannot be accepted for return or resale. All opened products are final sale.
5.2 Damaged or Faulty Shipments: If your order arrives physically broken, leaking, or defective, you must notify LYX Fragrance Lab Co. within 48 hours of carrier delivery with photograph/video evidence of the defect to qualify for a replacement or store credit.
SECTION 6 - GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
